Snack App Privacy Policy

Meet Muse Media Inc. (the “Company,” “us” or “we”) is the provider of Snack, a dating app focused on Gen Z. We recognize that your privacy is important, and that your choice to share information with us is a critical part of how we help people connect. The Privacy Notice below describes how and why we collect, use and share your personal information.

This Privacy Notice applies to our collection of personal information through the use of the Snack App (the “App”).

Please note that this Privacy Notice does not apply to our processing of personal information collected on the Snack Website, or about our employees or contractors. For information about the privacy policy for our Snack Website, please visit www.thesnackapp.com/snack-website-privacy-notice.

1.       COLLECTION AND USE OF INFORMATIONWhen we use the term “personal information” in this Privacy Notice, we mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to you. It does not include aggregated or de-identified information that is maintained in a form that is not reasonably capable of being associated with or linked to you.

We collect and use personal information in a variety of different ways:

A.      Information You Provide to Us

Account Registration.  In order to use the App, you are required to download, install and log-in using the App. To log-in to the App, you can choose to create an account or to sign in through your Apple ID or other third-party platform account. If you create an account, we may collect your full name, email, phone number and password that you select to create an account with us. We use this information to create and administer your account and use of the App.
 
Profile Creation.  To create your profile, you provide us with personal information including a profile image, age, geographic location (determined from GPS coordinates – see Location Information, below), gender, gender preference, and relationship interest. You may post short videos, texts, and images to your profile. We may use and disclose this information to anyone else registered for an account for the purpose of “matching” account users.

Matching.  To allow you to match with other users, your profile information will be available to other users in your geographic area based on your and their location information (described below). You will also be able to view the profiles of other users in your geographic area. Which profiles you view, and who may view your profile, will depend on the age, gender, gender preference, and location preferences and settings that you set in your profile. If two users “like” one another, they match, and direct messages are enabled.  A user may choose to “unmatch” with any other user at any time.

Direct Messaging.  When two users match, they may choose to send one another direct messages, including text, images, and short videos. We collect and store the contents of direct messages to enable the direct messaging function. We also use automated tools to “flag” direct messages which contain keywords indicative of potential fraud, illegal activity, and/or breaches of our Terms of Service. We may review direct messages: (a) which receive such “flags”; or (b) where one of the parties to the direct message conversation reports a breach of our terms of service. We review direct messages to help ensure the safety of users of the App, to suppress fraud and improper use of the App. We do not review direct messages otherwise, unless required or permitted by applicable law.

Location Information.  If you give us permission, we collect your location information by accessing your device’s GPS coordinates so that we can provide you with location-based services, such as providing you with potential “matches” based on the physical location of your device. You can opt-out of location tracking at any time by turning off your location services for the App in the settings of your mobile device.

Newsletter and Marketing Messages.  We collect your name and email address when you create an Account on the App, and you will be signed up to receive email marketing communications with updates and other information regarding the Company, the App and our Services. You can opt out of receiving marketing emails from us using the opt-out or “unsubscribe” instructions provided in the communication. Alternatively, you may contact our Privacy Officer at privacy@thesnackapp.com.  Please note that you may continue to receive certain transactional or account-related communications from us.


B.      Information We Collect Automatically

We use various technologies to collect information about the device you use to navigate the App, including:

App Usage Information & Analytics.  As with many applications, certain limited data is required for the App to function on your device. This data includes the type of device hardware and operating system, unique device identifier, IP address, language settings, and the date and time the App accesses our servers. We use this information to help us understand the activity on our App, to monitor and improve our App, and to tailor your in-App experience. In addition, we may use third party service providers to collect analytical information about your use of the App, such as the App features used and time spent on the App, to help us tailor your in-app experience, improve our products and the quality of our App, and to manage and analyze data in order to better understand our users.

Google Analytics.  We use “Google Analytics” to collect information about your use of the App.  Google Analytics collects information such as how often users access the App, what pages they access when they do so and what other sites or apps they used prior to using the App.  Google uses the data collected to track and examine the use of the App, to prepare reports on its activities and share them with other Google services.  To learn more about the use of data collection technologies by Google for analytics and to exercise choice regarding those technologies, please visit the Google Analytics Opt-Out browser add-on page, available at https://tools.google.com/dlpage/gaoptout.

C.      Other Uses of Personal Information

In addition to the uses described above, we may collect and use personal information for the following purposes:
To create, maintain, improve, and operate the App.
To personalize your user experience.
To communicate with you and to respond to your inquiries.
To conduct, manage, and grow our organization.
To analyze, research, investigate and improve the use of our App and interactions with users.
To prevent, investigate, and provide fraud notifications, unlawful or criminal activity, unauthorized access to or use of personal information, our data system services, and to meet governmental and institutional policy obligations.
To investigate and resolve disputes and security issues and to enforce our Terms of Use, available at www.thesnackapp.com/terms-of-use.

2.       SHARING OF PERSONAL INFORMATION

We may share your personal information in the following ways:

Service Providers.  Your personal information may be transferred (or otherwise made available) to third parties who provide services on our behalf, such as technology providers who host and manage the App and our email communications providers, analytics providers and data storage providers. 

Legal and Compliance.  We and our service providers may provide your personal information in response to a search warrant or other legally valid inquiry or order, or to another organization for the purposes of investigating a breach of an agreement or contravention of law or detecting, suppressing or preventing fraud, or as otherwise required or permitted by applicable Canadian, US or other law or legal process. Your personal information may also be disclosed where necessary for the establishment, exercise or defence of legal claims and to investigate or if we determine its disclosure is necessary to protect the health and safety of you or any other person, to protect against fraud or credit risk, or to enforce our legal rights or contractual commitments that you have made.

Sale of Business or Assets
.  Personal information may be provided to third parties in connection with a merger or sale (including transfers made as part of insolvency or bankruptcy proceedings) involving all or part of the Company or as part of a corporate reorganization or stock sale or other change in corporate control, including for the purpose of determining whether to proceed or continue with such transaction or business relationship.

Publicly.  If you create an account with us, we may make your profile information publicly available to other individuals on the App and through our Snack website.  Your personal information may be maintained and processed by us, our affiliates, and other third-party service providers in the US or other jurisdictions. In the event that personal information is transferred outside of Canada to the US or other foreign jurisdiction, it will be subject to the laws of that jurisdiction and may be disclosed to or accessed by the courts, law enforcement and governmental authorities in accordance with those laws

3.       ONLINE PRIVACY CHOICE

You have some choices regarding how we use your personal information, including the following: 

Interest-Based Advertising.   We support the self-regulatory principles of the Digital Advertising Alliance (“DAA”) and the Digital Advertising Alliance of Canada (“DAAC”). We work with third parties such as ad networks and other advertising companies, including Google, Facebook and Twitter, that use their own tracking technologies to provide you with tailored advertisements across the internet. These companies may collect information about your activity on the App, including device identifiers, and use this information to make predictions about your preferences, develop personalized content and deliver ads that are more relevant to you on third party websites, including ads that are about the App. This information may also be used to evaluate the effectiveness of our online advertising campaigns.

For more information about how our ad partners use the information collected by these technologies and your options for restricting cookies placed by some of these ad partners, please visit the DAA’s opt-out page at optout.aboutads.info/ or the DAAC’s opt-out page at youradchoices.ca/choices.  The DAA’s and DAAC’s opt-outs are device- and browser-specific and may not work on all devices.  If you choose to opt-out through the DAA’s tools it does not mean you will cease to see advertising. Rather, the ads you see will be based on the website you are visiting and not your interests. 

Accessing, Modifying or Deleting Your Information.  You can visit your profile in the App to update your photos and profile information at any time.  If you have questions about reviewing, changing, or deleting your information, you can contact us directly by emailing or writing to us at the contact information set out below. We may request certain personal information for the purposes of verifying the identity of the individual seeking access to their personal information records.

How to Control Your Email Communications Preferences.  You can stop receiving promotional email communications from us by clicking on the “unsubscribe link” provided in the email.  You may not opt-out of Service-related communications (e.g., transactional communications, changes/updates to features of the Snack Website, technical and security notices).

Modifying Your Device Settings.  You can restrict the App from accessing certain device information, such as precise geolocation, or from sending you push notifications by changing your permissions in your mobile device’s settings menu.  Please note that the withdrawal of permission to access some device information may result in an inability to take full advantage of our App. 

4.        THIRD PARTY WEBSITES 

The App may contain links to other websites that are not owned or controlled by us. We have no control over, do not review and are not responsible for the privacy policies of or content displayed on such other websites. When you click on such a link, you will leave our service and go to another website. During this process, another entity may collect personal information from you. Similarly, the App may contain integrations with third-party services, including those of our business partners.  By interacting with these third parties, you are providing information directly to the third-party and not us.  Please note that we are not responsible for the privacy practices of these third parties or any entity that we do not own or control.  We encourage you to review the privacy policies and online terms of those third parties to learn more about how they handle your personal information.

5.       CHILDREN’S PRIVACYUse of the Snack App is restricted to users who are 18 years of age or older. The Snack App is not targeted towards users under the age of 18.  We do not permit users under the age of 18 to use our App, and we do not knowingly collect or use personal information from anyone under the age of 18. 6.       REGION-SPECIFIC NOTICESWe may choose or be required by law to provide different or additional disclosures relating to the processing of personal information about residents of certain countries, regions or states. Please refer below for disclosures that may be applicable to you:

If you are a resident of Canada, please know we have implemented reasonable administrative, technical and physical measures in an effort to safeguard the personal information in our custody and control against theft, loss and unauthorized access, use, modification and disclosure. It is our general policy to restrict access to your personal information on a need-to-know basis to employees and authorized service providers who require access to fulfill their job requirements. We have personal information retention processes designed to retain personal information for no longer than necessary for the purposes stated above or to otherwise meet legal requirements.

We may update this Privacy Notice to reflect changes to our privacy practices. We encourage you to periodically review this page for the latest information on our privacy practices.  If we make material changes to this Privacy Notice, we will notify you by email to your registered email address, by prominent posting on our online services, or through other appropriate communication channels. All changes shall be effective from the date of publication unless otherwise provided in the notification.
